Terms of Service

These Terms of Service ("Terms") form a legal agreement between you ("you," "your") and Typealoud ("we," "us," "our"), the operator of typealoud.com (the "Site"). The Site is operated from the Province of British Columbia, Canada. Please read these Terms carefully. By accessing or using the Site, you agree to be bound by them. If you do not agree, you must stop using the Site.

1. About the Site

Typealoud is a free, opinionated discovery interface for open-source fonts and related typographic content. We aggregate, preview and link to typefaces that are made available by their respective designers and foundries under permissive open-source licences. We also publish editorial content — essays, guides and how-tos — on the typography blog.

2. Eligibility

You may use the Site if you are at least 13 years old and capable of forming a binding contract under the laws of British Columbia. If you use the Site on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

3. Permitted use of the Site

We grant you a personal, non-exclusive, non-transferable, revocable licence to access and use the Site for your own personal and internal commercial purposes, subject to these Terms. You may browse the catalogue, preview fonts, search and read articles, and copy short excerpts for your own non-commercial reference with attribution to Typealoud.

4. Font licensing — important

Typealoud does not own the typefaces it displays. Every typeface is the property of its original designer or foundry and is made available under its own licence, typically the SIL Open Font Licence 1.1, the Apache 2.0 Licence or a similar permissive licence. When you download a font from a link surfaced by the Site, you are downloading it from the upstream provider, and your rights and obligations are governed by that font's licence — not by these Terms.

You are solely responsible for reading and complying with the applicable font licence before using a typeface in any project. The information we surface about a font's licence is provided in good faith but is not a substitute for the licence file shipped with the typeface. If you are unsure, do not use the font until you have professional advice.

5. Acceptable use

You agree that you will not, and will not permit any third party to:

  • scrape, crawl, mirror or otherwise extract the Site in a manner that materially burdens our infrastructure or degrades service for other users;
  • attempt to gain unauthorised access to any system, account or data associated with the Site;
  • interfere with or disrupt the integrity or performance of the Site, including through denial-of-service or rate-limit-circumvention activity;
  • upload, post or transmit any unlawful, infringing, defamatory, harassing, deceptive or malicious content;
  • impersonate any person or misrepresent your affiliation with any person or entity;
  • use the Site or its content to train, fine-tune or evaluate any machine-learning model without our prior written consent; or
  • use the Site in any way that violates applicable law in British Columbia, Canada or any other jurisdiction from which you access the Site.

6. Intellectual property in the Site

The Site itself — including its design, source code, structure, editorial content, brand, logos and original images — is owned by Typealoud or licensed to us, and is protected by Canadian and international copyright, trademark and other intellectual-property laws. Other than the limited licence in section 3, nothing in these Terms transfers any intellectual-property right to you.

7. User submissions and feedback

If you submit a font for inclusion, send us a bug report, suggest editorial topics or otherwise provide ideas or content ("Submissions"), you grant Typealoud a perpetual, irrevocable, royalty-free, worldwide licence to use, reproduce, modify and distribute the Submission as part of operating and improving the Site, subject to applicable law. You confirm that you have the right to make the Submission and that it does not infringe the rights of any third party.

8. Third-party links and services

The Site links to third-party websites, font hosts and tools that we do not control. We provide these links for convenience only and do not endorse, monitor or accept responsibility for the content, policies or practices of those third parties. Your use of any third-party site or service is at your own risk and is governed by the terms of that third party.

9. Disclaimers

To the maximum extent permitted by the laws of British Columbia and Canada, the Site and all content on it are provided "as is" and "as available," without warranties or conditions of any kind, whether express, implied or statutory, including without limitation any implied warranty or condition of merchantability, fitness for a particular purpose, accuracy, non-infringement or quiet enjoyment. We do not warrant that the Site will be uninterrupted, error-free, secure or free of harmful components, nor that any information on the Site is complete, current or accurate.

10. Limitation of liability

To the maximum extent permitted by applicable law, neither Typealoud nor any of its directors, officers, employees, contractors or partners will be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill or business opportunity, arising out of or in connection with your use of, or inability to use, the Site, whether based in contract, tort (including negligence), statute or any other legal theory, and whether or not we have been advised of the possibility of such damages. Our aggregate liability for all claims relating to the Site is limited to one hundred Canadian dollars (CAD $100). Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including consumer-protection legislation in force in British Columbia.

11. Indemnification

You agree to defend, indemnify and hold harmless Typealoud and its directors, officers, employees and contractors from and against any claims, damages, losses, liabilities, costs and expenses (including reasonable legal fees) arising from or related to: (a) your access to or use of the Site; (b) your violation of these Terms; (c) your violation of any third-party right, including any font licence, intellectual-property right or privacy right; or (d) any content you submit to the Site.

12. Termination

We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including any actual or suspected breach of these Terms. Sections that by their nature should survive termination — including sections 4, 6, 9, 10, 11, 13, 14, 15 and 16 — will survive.

13. Changes to the Terms or the Site

We may modify these Terms or the Site at any time. Material changes will be announced on the Site at least 30 days before they take effect. Continued use of the Site after the effective date of any change constitutes acceptance of the revised Terms. If you do not agree to a change, you must stop using the Site.

14. Governing law and jurisdiction

These Terms, and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them or their subject matter, are governed by and construed in accordance with the laws in force in the Province of British Columbia and the federal laws of Canada applicable in that province, without regard to conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

You and Typealoud each irrevocably submit to the exclusive jurisdiction of the courts located in Vancouver, British Columbia, for the resolution of any such dispute or claim, except that we may seek injunctive or equitable relief in any court of competent jurisdiction to protect our intellectual-property rights or the integrity of the Site.

15. Dispute resolution

Before commencing any court action, you agree to attempt in good faith to resolve any dispute by contacting our team at legal@typealoud.com and allowing us 30 days to respond. Where the dispute involves a consumer covered by the British Columbia Business Practices and Consumer Protection Act, your rights under that statute are preserved.

16. Miscellaneous

These Terms, together with our Privacy Policy and Disclaimer, constitute the entire agreement between you and Typealoud concerning the Site, and supersede any prior agreement. If any provision is held unenforceable, the remaining provisions remain in full force. Our failure to enforce any right is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, reorganisation or sale of substantially all of our assets. Notices to you may be posted on the Site or sent to any email address you have provided.
